Hi. I’ve seen the same issue raised at my condo. Unfortunately for you and your family, there is not much you can do. Your neighbor is in his full right to smoke in his house and/or backyard/balcony.

You should consider closing all doors and windows. Before you say, “But why can’t he stop smoking?” just put yourself in his place: he’ll say “Why doesn’t he just block all the windows and doors?”

You have as much as a right to clean air as he has the right to smoke. There is nothing that can be done other than persuasion or moving out. I am sorry.

I asked your question on Yahoo answers and I got a couple of great results.

1.Try to report him to the EPA or ask the American lung association.

Everyone has rights but if they infringe on other peoples rights then they are no longer considered a “right”.

2.Put a fan in it backwards to keep the smoke from coming in. You can’t tell him not to smoke it is his right.
